A 16-year-old boy was accused of raping a 16-year-old girl who was intoxicated in a dark basement of a house party in 2017 in New Jersey, USA. He also allegedly video recorded the incident where the girl's bare torso was exposed and her head banged against the wall, reports CNN.

Judge denies to charge teen with rape because he is from good family

Even after the girl pleaded him to stop spreading the video, the boy allegedly sent the video to his friends texting "when you first time having sex was rape," according to documents.

Prosecutors pushed for the juvenile to be tried as an adult but in 2018, a judge denied the request citing that it isn't necessarily a rape as "traditional" rape involves 2 or more men manhandling a person at gunpoint or weapon and called it sexual assault.

He further said that the boy was from a "good family" and went to "excellent school" and will be headed for "good college" as his scores were "terrific."

He went on to say that prosecutors should have explained to the girl and her family that pressing charges would destroy the boy’s life, reports Independent.

Now Appeals Court has rebuked the judge and moved the accused to be tried as an adult.
