Madras High Court has imposed an interim ban on using Mersal name for promotion

Based on the complaint filed by producer Rajendran, Madras High Court has imposed an interim ban on using Mersal name for promotion. Rajendran had apparently registered the title Merrasalaitan in 2014. The case comes to hearing on the 3rd of October.

Rajendran of AR Film Factory has issued an official addressing Vishal, President of Tamil Film Producer Council:

"In 2014 we had registered the title of Merrasalaitan and we wanted to start shooting this year. Actors and the crew have been given advance payments and they have started to work on the pre-production; that is when Mersal's title announcement was made. If this Vijay film releases with Mersal title, then there is a chance that our film might not release and that could put me in a serious financial trouble. So we request the Producer Council to take legal action on this issue. Our registration for this title Merrasalaitan stays valid till January 2018.

Earlier Vikram's Iru Mugan team had applied for Mersal title but then the Producer Council was in support of us and we had jointly denied NOC certificate for Iru Mugan team. A similar situation occurred when producer Thiyagarajan had applied for Mersal title in 2016.

Team Mersal has registered the title only in South Indian Film Chamber and not in TFPC. So they released the first look even without getting NOC from TFPC. The very next day of Mersal first look launch, I had gone to TFPC office and talked about my issue. I was told they would revert back in 2 months but I have not got any information from them till now.

This Vijay film could very well eat away the business of my film if it releases with Mersal title which would put me in a bad state financially. I have invested so much and it might also force me to commit suicide.

When producer Thiyagarajan was denied this title in 2016, how come TSL managed to acquire this title? As the President of Producer Council, we request Vishal sir to help us in solving this issue.

If Mersal team cannot use the title for promotion, then that could be a minor setback for them. We hope the producers settle this issue amicably soon. Vijay's Thuppakki faced a similar issue as another film had acquired the rights to the title Kallathuppakki.
